RESOLUTION OF THE BOROUGH OF LAVALLETTE, COUNTY OF OCEAN, STATE OF NEW JERSEY DECLARING THE BOROUGH OF LAVALLETTE A MILITARY FRIENDLY TOWN AND ENCOURAGES ALL ITS BUSINESSMEN TO OFFER DISCOUNTS TO THOSE WHO SERVE IN THE MILITARY

WHEREAS, the men and women who serve in our military forces have dedicated their lives to protect our country, our freedoms and our safety; and

WHEREAS, those currently serving in the military could be assigned a tour of duty in Iraq or Afghanistan, placing their lives in danger for our freedom; and

WHEREAS, the Mayor and Council of the Borough of Lavallette wish to formally go on record as declaring the Borough of Lavallette as a military friendly town; and

WHEREAS, the Mayor and Council wish to show their support for those

that serve our country and protect our freedom and safety and further wish to encourage our businessmen to offer discounts to military personnel and urge our residents and businessmen to roll out the red carpet for our military men and women.

NOW, THEREFORE, BE IT RESOLVED, by the Mayor and Council of the Borough of Lavallette, County of Ocean, State of New Jersey, as follows:

1. That the Mayor and Council do formally declare the Borough of Lavallette a military friendly town. The Borough of Lavallette does hereby declare its support for our military forces and personnel and acknowledge the efforts to protect our freedom and safety, not only at home, but also abroad.

2. That the Mayor and Council do urge our businessmen in the Borough of Lavallette to offer discounts to military personnel.

3. That the Mayor and Council urge all residents and business persons to

extend the red carpet to our military service men and women by

extending friendly and warm greetings to them and to show our

gratitude by extending every courtesy to them.

AN ORDINANCE OF THE TOWNSHIP OF BERKELEY AMENDING CHAPTER XXVI OF THE REVISED GENERAL ORDINANCES OF THE TOWNSHIP OF BERKELEY ENTITLED “BEACHES AND RECREATIONAL AREAS.”

December 8, 2009

BE IT ORDAINED AND ENACTED BY THE TOWNSHIP COUNCIL OF THE TOWNSHIP OF BERKELEY, COUNTY OF OCEAN AND STATE OF NEW JERSEY, as follows:

SECTION 1. Chapter XXVI, § 26-1.19 entitled "Recreation Exemptions" shall be amended as follows:

26-1.19 Recreation Exemptions.

a. A disabled veteran of any war, who is a permanent resident or taxpayer of the Township and who is certified by appropriate Federal authorities as being qualified for a permanent combat related disability of thirty (30%) percent or more, shall be exempt from the payment of any fees or other charges for the use of any recreational facilities of the Township as provided for in this Code.

b. Definitions. As used in this chapter:

Veteran shall mean any person who has served and was discharged under honorable conditions or is currently serving the country in the Army, Navy, Air Force, Marines and Coast Guard, including all Reserves and National Guard personnel attached to these branches, as well as those who serve in the Merchant Marine in time of war.

Veteran of any war shall mean any veteran who served in the active military, naval or air service during a period of war.

c. All active military service members, spouses and their children shall be exempt from the payment of any fees or other charges for the use of any recreational facilities of the Township as provided for in this Code upon presentation of appropriate identification.

SECTION 2. If any section, subsection, sentence, clause, phrase or portion of this Ordinance is for any reason held invalid or unconstitutional by any court or federal or state agency of competent jurisdiction, such portion shall be deemed a separate, distinct, and independent provision and such holding shall not affect the validity of the remaining portions hereof.

SECTION 3. All ordinances or resolutions or parts of ordinances or resolutions inconsistent herewith are hereby repealed to the extent of such inconsistency.

SECTION 4. Pursuant to the provisions of law, this Ordinance shall take effect twenty (20) days after its passage by the Township Council and approval by the Mayor, where such approval is required by law.

WHEREAS, the Mayor and Borough Council of the Borough of Bay Head seek to formally designate the Borough as “military friendly;” and

WHEREAS, the Mayor and Borough Council of the Borough of Bay Head wish to show their support for those that serve our country and protect our freedoms, and further wish to encourage our local businesses to offer military discounts to those serving in the armed forces; and

WHEREAS, recognizing the sacrifices made by the members of our armed forces, the Bay Head Improvement Association already provides free beach badges to active military members, their spouses, and eligible children; and

WHEREAS, all residents and businesses are encouraged to support our military personnel.

NOW, THEREFORE, BE IT RESOLVED, by the Mayor and Borough Council of the Borough of Bay Head, County of Ocean, State of New Jersey, that:

1. The Mayor and Borough Council formally declare Bay Head as “military friendly.” The Borough of Bay Head declares its support of our military personnel and acknowledges the efforts and sacrifices our servicemen and servicewomen make each day to protect our freedoms and to ensure our safety.
